Terms & Conditions

For Use By: Burks Foundation Roadside Programs / RoadGuard Roadside Assistance / Light Wheel Program

Service Area: Texas and surrounding approved coverage areas

1. Acceptance of Terms

By requesting, scheduling, purchasing, or receiving roadside assistance services, the customer ("Client") agrees to these Terms and Conditions. Services are provided by independent contractors, technicians, or affiliated service providers operating under programs supported by The Burks Foundation and related roadside assistance operations.

2. Services Provided

Roadside assistance services may include, but are not limited to:

  • Tire changes
  • Jump-starts
  • Fuel delivery
  • Lockout assistance
  • Battery assistance
  • Minor roadside repairs
  • Trailer assistance
  • Equipment transport support
  • Emergency roadside dispatch
  • Mobile mechanic support
  • Winch-out services (if available)
  • Towing coordination (third-party provider)

Services are subject to technician availability, weather conditions, safety concerns, and geographic coverage.

3. Independent Contractor Disclosure

Roadside technicians may operate as independent contractors and are not employees of the platform unless explicitly stated otherwise. Each technician is responsible for:

  • Maintaining required insurance
  • Operating safe equipment
  • Following local and state laws
  • Maintaining valid licenses where required

4. Customer Responsibilities

The customer agrees to:

  • Provide accurate location information
  • Maintain a safe environment for service
  • Disclose hazards or unsafe conditions
  • Remain respectful toward staff and technicians
  • Secure pets and valuables
  • Stay a safe distance from traffic during service

Failure to provide accurate information may result in delays, cancellation, or additional charges.

5. Emergency & Safety Conditions

Technicians reserve the right to refuse service if:

  • Conditions are unsafe
  • Weapons are present
  • Illegal activity is suspected
  • Weather conditions create hazards
  • The vehicle location is inaccessible
  • The customer behaves aggressively or abusively

If law enforcement or emergency services are required, additional delays may occur.

6. Non-Refundable Dispatch Fees

Certain fees are non-refundable, including:

  • Emergency dispatch fees
  • Missed appointment deposits
  • Late cancellation fees
  • After-hours dispatch charges
  • Travel or mileage charges once technician dispatch begins

Emergency Service Surcharge: $75.00 | Missed Appointment / No-Show Deposit: $25.00

7. Cancellation Policy

Customers may cancel service before technician dispatch without penalty unless otherwise stated. Once a technician is dispatched:

  • Dispatch fees become non-refundable
  • Mileage and time charges may apply
  • Cancellation after arrival may result in full service charges

8. Payment Terms

Payment is due at the time of booking unless otherwise approved. Accepted payment methods may include:

  • Stripe
  • Credit/Debit Card
  • Digital Wallets
  • Approved electronic payment systems

Failure of payment authorization may result in service denial.

9. Vehicle Damage Disclaimer

Roadside assistance involves inherent risks. The company is not responsible for:

  • Pre-existing vehicle damage
  • Mechanical failures unrelated to services performed
  • Tire blowouts after installation
  • Electrical failures
  • Hidden mechanical issues
  • Damage caused by defective parts
  • Manufacturer defects

Customers are encouraged to inspect vehicles before and after service.

10. Limitation of Liability

To the fullest extent permitted by law, the company, foundation, dispatch center, platform operators, and technicians shall not be liable for:

  • Indirect damages
  • Lost wages or lost business
  • Consequential damages
  • Delays due to traffic/weather
  • Personal property loss
  • Emotional distress claims

Maximum liability shall not exceed the amount paid for the specific service event.

11. Towing & Third-Party Services

Some services may be performed by third-party providers. We are not responsible for:

  • Third-party towing damages
  • Storage fees
  • Delays caused by third-party companies
  • Pricing changes by outside vendors

Customers may be required to sign additional agreements with towing providers.

12. Insurance Requirements for Providers

Participating providers/technicians may be required to maintain:

  • General Liability Insurance
  • Commercial Auto Insurance
  • Minimum coverage standards (example: $300,000 CSL)

Proof of insurance may be requested by the platform administrator.

13. GPS & Communication Consent

By using the service, the customer consents to:

  • GPS location tracking for dispatch purposes
  • SMS/email notifications
  • Automated appointment reminders
  • Status updates regarding service

Message and data rates may apply.

14. Photo & Verification Authorization

Customers may be required to provide:

  • Photo identification
  • Vehicle registration verification
  • Photos of vehicle condition
  • Signature confirmation

Verification measures help reduce fraud and improve safety.

15. Service Time Estimates

Estimated arrival times are not guaranteed and may vary due to:

  • Traffic
  • Weather
  • Technician availability
  • Emergency call volume
  • Distance

16. No Guarantee of Repair

Roadside assistance is intended for temporary or emergency support only. No guarantee is made that:

  • The vehicle will remain operational
  • The repair is permanent
  • Additional repairs will not be necessary

17. Membership Programs

If enrolled in a membership or subscription plan:

  • Benefits apply only during active membership periods
  • Memberships may have service limits
  • Abuse of membership benefits may result in termination

18. Prohibited Conduct

Customers may not:

  • Use services fraudulently
  • Misrepresent breakdown conditions
  • Threaten or harass technicians
  • Request illegal activities
  • Attempt chargeback fraud

Violations may result in permanent service denial.

19. Governing Law

These Terms and Conditions shall be governed by the laws of the State of Texas unless otherwise specified.

20. Modifications

The company reserves the right to update or modify these Terms and Conditions at any time without prior notice. Updated versions become effective upon publication.
